It's illegal in Washington State, everywhere else I think it's pretty legal. They found loop holes through the UIGEA if i'm not mistaken, so poker in the U.S. isn't illegal.

id really doubt in a state where internet poker is banned that its enforced like ever lol but i may be wrong ;p

anyway, a bigger question is if you can't pay taxes(can you?) on poker earnings then its basically dirty money, right? and somewhat illegally obtained money, and could cause problems?
