DOJ rejects Lederer's request for conference

Last week, Federal Judge Jack Weinstein ruled that the game of poker is “predominated by skill.” It was the US vs Dicristina case. Dicristina had been arrested in 2011 for operating illegal gambling business in New York. In the end, Judge Weinstein dismissed the indictment and set the jury's guilty verdict aside. That ruling marks the first time that a Federal court in the US has recognized poker as skill rather than gambling. The decision can still be reversed though, as it will most likely be appealed.

After that decision, Howard Lederer's lawyer tried to use it in his favor by writing to the Federal Court and asking for a status conference (a pre-trial meeting of attorneys before a judge) to discuss the impact of the ruling on Lederer's case. According to them, since poker is a game of skill, it's not considered illegal gambling under the Illegal Gambling Business Act (IGBA) and therefore the government's allegations against Lederer have no "legal basis." Chris Ferguson and Rafael Furst, co-defendants, have agreed to be included in the request.

US District Attorney Preet Bahara was quick to reject Lederer's arguments. He doesn't agree that the ruling on Dicristina's case have any effect on Lederer's charges and that he plans to file an amended complaint with additional statutory grounds for forfeiture and other relief by September 10. Bahara argues that even if the ruling is upheld, it still wouldn't affect the charges or help Lederer.

I've mentioned this before, but considering how much money there is in poker, I'm also surprised how there's never really any stories about people people getting jumped, robbed, killed for their poker money. And if there are some stories, I'd be interested in reading about them, so link away.

those are 3 that came off the top of my head. There are tons more, especially people getting jacked in and around casinos (but not necessarily poker players)

home games get robbed all the fucking time, but since the games are often illegal they cant exactly go to the police.

Casinos are one of the most well surveillanced and guarded places on earth. Even in their parking structures. Even stupid criminals know this. This is why they don't try to rob poker players often there.

Then trailing someone home and doing a home invasion is a whole different thing. It takes a real crazy fuck do to that. Even then, the VAST majority of live poker pros keep crazy hours, and are probably out all night most of the time. So even if you are one of the few crazy fucks down to do a home invasion when the player is home so you can get his safe codes/key and shit off him or straight cash, you'd have to do it in the day time. Another thing criminals don't like to do.

I think there is a misleading headline to this story, Howard's lawyer sent this request to the judge, it's up to the judge to decide if he gets his conference. The DoJ is not in a position to "reject" anything. They can dispute it, oppose it, whatever, but isn't it still up to the court to decide if he gets a conference?
